Privacy policy

This policy explains how your personal data is processed, in accordance with the European Union’s General Data Protection Regulation, where applicable, and Federal Decree-Law 45 of 2021 of the United Arab Emirates.

1. Data controller

The controller is M.G.M. Legal Consultancy FZE. Its full details appear in the legal notice. For any question about your data, write to info@martingomez.ae.

2. What data is processed and where it comes from

The data comes directly from you:

  1. Enquiry form: name, email address, type of matter and the message you write.
  2. WhatsApp and email: the data you include when writing.
  3. Technical data: what is essential for the website to work and remain secure, such as the IP address in server logs.

Please bear in mind that:

  1. You should not send confidential information, documents or special categories of data, such as health data, in this first contact.
  2. If you include data about other people, you must have informed them and have their authorisation.
  3. You must provide accurate and up-to-date data.

3. What it is used for and on what basis

You can withdraw your consent at any time, without affecting processing carried out until then. Your data is not used to send you advertising or to build profiles, and no automated decisions are taken about you.

4. How long it is kept

  1. Data from an enquiry that does not lead to an engagement is kept for a maximum of 12 months.
  2. If an engagement is formalised, data is kept for the duration of the professional relationship and for the periods required by law, including anti-money laundering rules.
  3. After those periods, it is securely deleted or blocked.

5. Who may receive it

Data is not disclosed to third parties for commercial purposes. It is accessed only by those members of my team who need it, by the authorities where the law requires, and by the providers needed to deliver the service:

  1. Web3Forms: sending the enquiry form.
  2. WhatsApp (Meta): if you choose to write through that channel.
  3. Email and web hosting providers.

If an engagement so requires, and after informing you, data may be shared with local lawyers, notaries, registries or competent authorities.

6. International transfers

  1. Data is processed in the United Arab Emirates, a country that does not have an adequacy decision from the European Commission.
  2. Some providers may process it in other countries.
  3. By ticking the box on the form you expressly consent to this transfer, which is necessary to deal with your enquiry. This transfer involves the risk that the destination country may not offer a level of protection equivalent to that of the European Union.

7. Security

Appropriate technical and organisational measures are applied to protect your data against loss, misuse and unauthorised access. No system is completely secure, so absolute security of communications over the internet cannot be guaranteed.

8. Minors

This website is aimed at people over the age of 18. Data from minors is not knowingly collected.

9. Your rights

You can exercise these rights at any time by writing to info@martingomez.ae:

  1. Access your data.
  2. Rectify it.
  3. Erase it.
  4. Restrict its processing.
  5. Object to it.
  6. Request its portability.
  7. Withdraw your consent.

You will receive a reply within the legal time limit. Some data may be retained where there is a legal obligation or where it is necessary to bring or defend claims.

You can also lodge a complaint with the relevant supervisory authority: in the European Union, the data protection authority of your country, and in the Emirates, the authority competent for data protection.

This policy may be updated. The date of the latest review appears at the top of the page.
